Fullpath Gives Priority to Customer Privacy
Fullpath values the privacy of car buyers and works hard to shield our dealers from legal issues that could arise from privacy concerns. We do use a third-party tool called Twilio to send automated SMS messages to our dealers’ customers regularly, which adheres to the highest standards of privacy laws.
Upcoming FCC Rule Change
On Friday, April 11th, the FCC's new rule regarding the right to revoke consent to robocalls and robotexts, called the Telephone Consumer Protection Act (TCPA), takes effect.
Key Points of the New Rule
The rule clarifies that:
- Dealers can only send robocalls and robotexts to customers who have given their consent.
- Users can revoke that consent in several different ways.
- Revocation requests must be honored within a reasonable timeframe, not exceeding 10 days.
- Dealers can only send one message confirming the revocation request.
Fullpath's Commitment to Compliance
Fullpath is fully compliant with all aspects of the new rule.
- Consent is Key:
- We only contact shoppers who have explicitly agreed to receive SMS messages.
- We check this by:
- Never contacting shoppers who have unsubscribed from any other SMS messages from the dealership. We only contact users who are not marked as “Do Not Contact.”
- Requiring dealers, as part of the onboarding process for our SMS tool, to provide proof that they explicitly ask for consent to contact via SMS on all their lead forms.
- Easy Opt-Out:
- If a user responds with “Stop,” “Unsubscribe,” or something similar, they are automatically unsubscribed from further SMS messages.
- Speedy Unsubscription:
- We unsubscribe users from our SMS system within minutes of their request.
- Dealers can schedule daily or weekly reports to review unsubscribed customers and update their CRM accordingly.
- No Further Contact:
- We do not send additional SMS messages after a user indicates they want to revoke consent.
Going the Extra Mile
To further ensure proper consent, we include “To opt out reply STOP” in the initial SMS sent to customers.
